BULAWAYO BUSINESSMEN IN US$30 MILLION FRAUD STORM

TWO Bulawayo businessmen appeared in court this morning in connection with a US$30 million fraud emanating from an alleged acquisition of a High Court order which granted them largest shareholding in a Mauritian company DGL Finance’s mining subsidiary All Aflame Marketing.

John Farley Pietersen and Peter Mark Johnstone allegedly obtained a default court order after they deliberately served other parties with court papers at a wrong address and obtained a default judgment before approaching the Registrar of Companies where they allegedly made themselves directors.
The were not asked to plead to two counts of fraud when they appeared before Regional Magistrate Jessie Kufa who remanded them out of custody to July 24 on US$500 bail.
The court heard that the two were applicants in a High Court matter with All Flame Marketing (Private) Limited being a respondent together with six others.
In the process of serving the court application documents for All Aflame (Private)
Limited to defend, the two allegedly hatched a
plan to prejudice the complainants and served  the court application papers at a wrong address despite knowing the correct address.
The State says the two knew about the address as they once served All Flame with summons commencing action and declaration filed  at the High Court.
The court heard that the two were even alerted by the sheriff that the company was no longer at those premises.
Claims are that due to this unlawful and intentional act the two knew complainants were no longer at the premises but misrepresented to the High Court of Zimbabwe that they had validly served the
court application at the company All aflame Marketing’s address yet that was not the correct address.
The court heard that the High court of Zimbabwe went and acted on the misrepresentation resulting in the granting of a default judgment which gave the
two 57,45% shareholding in All Aflame Marketing to the prejudice of DGL Finance Limited, David Easterbrook and Allan Dolan.
The two allegedly approached the Registrar of Companies and misrepresented that the
company’s directors David Peter Easterbrooke and Allan Brent Dolan had resigned on 13 May 2026 and that they were now the rightful owners and directors
of All Aflame Marketing [Pvt] Ltd due to the said Court order.
Allegations are that the duo knew that they had fraudulently obtained the said court order
through misrepresenting to the High Court of Zimbabwe and knew that the Registrar of Companies was going to act upon the misrepresentation and listed them as the new directors of the company and the complainant and his co-director Allan Brent Dolan removed on
the basis of resignation which was not correct.
The State says the two knew that Easterbrook and Brent Dolan had never resigned and that the High Court
order tendered to the Registrar never ordered or mentioned about the resignation or removal from directorship.
